Dear friends,
February 2022 was marked by notable progress in the fight against impunity of international crimes committed in Switzerland, but also across the world.
Indeed, after 10 years of legal proceedings and windy judicial road, the way is finally open for the start of the trial of General Khaled Nezzar in Switzerland. This is a giant step for universal jurisdiction and the prosecution of those responsible for international crimes, supported by TRIAL International.
We also welcome the National Council in Bern Legal Affairs Commission’s decision, on February 4, to introduce into Swiss criminal law a specific offense regarding torture. This is an essential first step for Switzerland to have a complete and compliant system criminalizing torture that would allow the prosecution of this crime with full efficiency.
In Bosnia and Herzegovina, TRIAL International has drafted and printed information leaflets to help war crime victims bring their claims before the courts, which demonstrates once again the organization’s commitment and support.
In addition, TRIAL International will be a part of the 20th Geneva International Film Festival and Forum on Human Rights (FIFDH) during an event co-organized with Arte and the City of Geneva, on March 12 at 4:30 p.m. The event will include the screening of the film “Invisible Demons” by Rahul Jain, which will be followed by a “Grand Interview”, “From Genocide to Ecocide”, with Philippe Sands about environmental protection.

After the formal criminal complaint filed by TRIAL International for war crimes in 2011, 10 years of investigation and many legal developments, the Public Ministry of the Confederation (MPC) held from February 2 to 4 the final hearing of Khaled Nezzar, Minister of Defense and leader of the military junta at the beginning of the civil war in Algeria.

Torture listed as an offense in the Swiss criminal code
The National Council's Legal Affairs Commission in Bern decided, on February 4, to introduce into Swiss criminal law a specific offense regarding torture. This parliamentary initiative was supported by several governmental organizations (ACAT, APT, Amnesty International, the Swiss Red Cross, OMCT and TRIAL International). TRIAL International welcomes this decision and stresses that it is an essential first step for Switzerland to have a complete and compliant system criminalizing torture that would allow the prosecution of this crime with full efficiency.

A brochure for victims of war crimes
In Bosnia and Herzegovina, TRIAL International is more than ever committed to assisting war crime victims. Indeed, they are generally not well informed on the means to seek reparations for the crimes they are victims of. TRIAL International supports and helps them in their quest for justice and has created a short leaflet detailing the steps to obtain free legal aid and how to better bring their claims.
